Terms of service
These are the terms on which Kasdena Ltd offers LandlordCheck to you. The short version is this. We sell a self-assessment tool for UK landlords. We are not a law firm. Findings are an opinion based on the answers you give us, not a guarantee of compliance. Our liability is capped, and we have to exclude responsibility for any fines or penalties imposed on you by a regulator. Everything below is the long version of the same idea.
1. Who you are contracting with
These terms form a contract between you and Kasdena Ltd, a company registered in England and Wales (company number [Company Number]), registered office [Registered Office], trading as LandlordCheck. References to “we”, “us” and “our” mean Kasdena Ltd. References to “you” and “your” mean the person buying or using the service.
2. What the service is
LandlordCheck is a software tool. You answer a structured set of questions about a UK rental property, and the tool applies a published rules engine to your answers and returns a written report. The report identifies areas where your answers suggest a possible non-compliance with named UK statutes, and suggests next steps. The rules engine version and the date the report was generated are printed on every report.
3. What the service is not
LandlordCheck is not legal advice. We are not a firm of solicitors, we are not regulated by the Solicitors Regulation Authority, and we do not provide regulated legal services within the meaning of the Legal Services Act 2007. The report you receive is general legal information applied to the specific answers you supplied. It does not create a solicitor-client relationship. It is not a substitute for advice from a qualified solicitor on your particular circumstances, and it should not be relied on for licensing prosecutions, possession proceedings, deposit disputes, disrepair claims, or any other contested matter.
4. Your answers and your responsibility
You are responsible for the accuracy of the answers you give the wizard. The report is generated mechanically from those answers. If your answers are wrong, incomplete, or out of date, the report will reflect that. We do not verify your answers against any third-party register, except for the postcode-to-council lookup that runs against postcodes.io and our internal record of selective licensing schemes. You agree that you are the landlord, an agent acting for the landlord, or otherwise authorised to seek a compliance assessment for the property in question.
5. Pricing, payment, and immediate delivery
The full report costs £19, payable through Stripe at checkout. The price is inclusive of any applicable VAT, currently zero (we are below the registration threshold).
Because the report is digital content delivered immediately, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you a 14-day right to cancel only if you have not yet consented to immediate performance. We ask for that consent at the checkout. When you tick the box that says “I agree the report can be delivered immediately, and I understand that by ticking this box I waive my 14-day cancellation right under the Consumer Contracts Regulations 2013”, you give that consent and lose the cancellation right. If you do not tick the box, you do not get the report.
If we make a material error in the report through our fault (for example a rule mis-applied through a code defect), email [Public Email] within 30 days of receipt and we will issue a refund of the £19 or a corrected report at our option.
6. Licence to use the report
We grant you a non-exclusive, non-transferable licence to use the report you bought for the property the report covers and for your own professional advisers. You may forward the PDF report to your letting agent, solicitor, accountant, mortgage broker, or any other professional adviser acting for you. You may not resell, rebrand, scrape, host, or use any part of the report or the underlying rules engine to provide a similar service to anyone else. You may not remove our branding from the report.
7. Intellectual property
All content on LandlordCheck, including the rules engine, the report layout, the wizard text, the brand and the design system, is the intellectual property of Kasdena Ltd. You buy a licensed copy of a single report; you do not buy any rights in the underlying content.
8. Limitation of liability
Subject to applicable law (including section 65 of the Consumer Rights Act 2015 which we do not exclude), our total aggregate liability to you for any and all claims arising out of or relating to the report and the service is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) £100.
We exclude liability for indirect or consequential loss, including loss of profits, loss of business, loss of opportunity, loss of goodwill, and any fines or penalties imposed on you by a regulator, local authority, court, or tribunal. This exclusion is the central commercial bargain reflected in the £19 price; it is not a hidden trick.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability we cannot lawfully exclude under English law.
9. Accuracy and updates to the rules engine
UK landlord legislation changes. We update the rules engine on a rolling basis. Each update is recorded on the rules changelog page. Reports reflect the rules as at the date and the rules-engine version printed on the report. We do not retroactively update reports that have already been issued. If a material change to the law happens within 30 days of your report, we will normally email you to flag it and offer a refreshed report at a discounted rate.
10. Insurance
Kasdena Ltd holds professional indemnity insurance with [Insurer] under policy number [Policy Number]. Cover details are available on request.
11. Privacy
How we collect, use and protect your data is set out in the privacy policy. The plain-English summary is at your data.
12. Updates to these terms
We may update these terms from time to time. The current version is always published at landlordcheck.uk/terms with the date at the top. If we make a material change to terms that affects customers who already bought a report in the previous 12 months, we will email those customers. Your continued use of the service after a change takes effect is acceptance of the updated terms.
13. Complaints and dispute resolution
If you are unhappy with the service, contact us at [Public Email]. We will acknowledge any complaint within 5 working days and respond substantively within 20 working days. If we cannot resolve a complaint to your satisfaction, you have the right to bring proceedings in the courts of England and Wales. We are not currently a member of an Alternative Dispute Resolution scheme; for online dispute resolution, the European ODR platform is at ec.europa.eu/consumers/odr (note: post-Brexit utility is limited).
14. Force majeure
We are not liable for any failure or delay in performance caused by an event beyond our reasonable control, including acts of God, war, riot, fire, flood, epidemic, pandemic, internet outage, hosting-provider failure, or government action.
15. Severability
If any provision of these terms is held by a court to be unlawful, void or unenforceable, that provision is severed and the rest of the terms continue in effect.
16. Assignment
You may not assign or transfer your rights under these terms. We may assign these terms (and the contract they form) to any company we acquire, are acquired by, merge with, or that buys substantially all of our assets.
17. Third parties
A person who is not a party to these terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms.
18. Governing law and jurisdiction
These terms, the contract they form, and any dispute or claim arising out of them or their subject matter (including non-contractual disputes or claims), are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
